Agreement to Terms

By accessing or using Vitrinap, you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, you may not use our platform. These Terms apply to all users, including store owners, agency partners, and agents.

Description of Service

Vitrinap is a SaaS platform that provides e-commerce and agency management services, primarily serving businesses in Guatemala. Our services include:

• Online store creation and management
• Product catalog and inventory management
• Order processing and tracking
• Agency and partner network management
• Sales analytics and reporting tools

Acceptable Use Policy

You agree to use Vitrinap only for lawful purposes and in accordance with these Terms. Specifically, you agree NOT to:

• Use the platform for any illegal activities or to sell prohibited goods
• Violate any local, national, or international laws or regulations
• Engage in fraudulent, deceptive, or misleading business practices
• Infringe on the intellectual property rights of others
• Upload malicious code, viruses, or any harmful software
• Attempt to gain unauthorized access to our systems or other user accounts
• Harass, threaten, or harm other users
• Use automated systems (bots, scrapers) without authorization

Account Registration and Security

To use certain features of Vitrinap, you must register for an account. You agree to:

• Provide accurate, current, and complete information during registration
• Maintain and promptly update your account information
• Keep your password secure and confidential
• Notify us immediately of any unauthorized use of your account
• Accept responsibility for all activities that occur under your account

Account Termination and Suspension

We reserve the right to suspend or terminate your account at any time, with or without notice, for any of the following reasons:

• Violation of these Terms of Service
• Engaging in illegal activities or fraudulent behavior
• Providing false or misleading information
• Non-payment of fees or subscription charges
• Causing harm to other users or our platform
• Any other conduct that we deem inappropriate or harmful

Upon termination, your right to use the platform will immediately cease. We may, but are not obligated to, delete your account data.

Payment and Fees

Certain features of Vitrinap require payment of subscription fees. By subscribing to a paid plan, you agree to:

• Pay all applicable fees as described on our pricing page
• Provide valid payment information
• Authorize us to charge your payment method on a recurring basis
• Understand that fees are non-refundable unless otherwise stated

We reserve the right to modify our pricing at any time. Changes will be communicated to you in advance and will apply to subsequent billing cycles.

Intellectual Property Rights

All content, features, and functionality of Vitrinap, including but not limited to text, graphics, logos, software, and design, are the exclusive property of Vitrinap and are protected by copyright, trademark, and other intellectual property laws.

You retain ownership of the content you upload to the platform (product listings, images, descriptions, etc.). By uploading content, you grant us a license to use, display, and distribute your content solely for the purpose of providing our services.

Disclaimer of Warranties

Vitrinap is provided on an "AS IS" and "AS AVAILABLE" basis. We make no warranties or representations, express or implied, regarding:

• The accuracy, reliability, or completeness of the platform
• Uninterrupted or error-free operation
• The security of your data or transactions
• The suitability of the platform for your specific business needs

To the fullest extent permitted by law, we disclaim all warranties, including warranties of merchantability, fitness for a particular purpose, and non-infringement.

Limitation of Liability

To the maximum extent permitted by law, Vitrinap and its affiliates, officers, directors, employees, and agents shall NOT be liable for:

• Lost Sales or Revenue: We are not responsible for any sales you may lose due to platform downtime, technical issues, or other disruptions
• Banking or Payment Errors: We are not liable for errors in payment processing, banking issues, or financial losses
• Data Loss: While we take measures to protect your data, we are not responsible for data loss or corruption
• Third-Party Services: We are not liable for issues arising from third-party integrations or services
• Indirect Damages: We are not liable for any indirect, incidental, consequential, or punitive damages

Our total liability to you for any claims arising from your use of Vitrinap shall not exceed the amount you paid us in the 12 months preceding the claim.

Indemnification

You agree to indemnify, defend, and hold harmless Vitrinap and its affiliates from any claims, damages, losses, liabilities, and expenses (including legal fees) arising from:

• Your use of the platform
• Your violation of these Terms
• Your violation of any laws or regulations
• Your infringement of any third-party rights

Governing Law and Jurisdiction

These Terms are governed by and construed in accordance with the laws of Guatemala. Any disputes arising from these Terms or your use of Vitrinap shall be resolved exclusively in the courts of Guatemala.

Data Protection and Privacy

Your use of Vitrinap is also governed by our Privacy Policy. By using our platform, you consent to the collection, use, and storage of your data as described in our Privacy Policy.

Changes to Terms

We reserve the right to modify these Terms at any time. We will notify you of any material changes by:

• Posting the updated Terms on our website
• Sending you an email notification (if applicable)

Your continued use of Vitrinap after changes become effective constitutes your acceptance of the revised Terms.

Severability
